Terms of Use
These terms govern your use of this website. They are not a services agreement. If PortNOC provides services to your organisation, those are governed by a separate signed agreement, and nothing on this website changes it.
1. Acceptance
By using portnoc.net you agree to these terms. If you do not agree with them, please do not use the site. The site is operated by PortNOC LLC, a Wisconsin limited liability company.
2. Information here is not an offer
The service descriptions, capabilities, regions, and engagement models set out on this site are provided for general information. They are not an offer, quotation, or commitment, and they do not form part of any contract.
What PortNOC is actually obliged to deliver for a given client — scope, coverage hours, response targets, escalation, and price — is defined solely in the managed services agreement, statement of work, or order form signed by both parties. Where anything on this website conflicts with a signed agreement, the signed agreement governs.
Submitting the assessment request form does not create a contract or a client relationship. It starts a conversation.
3. Permitted use
You may read this site, and share links to it. You may not:
- attempt to gain unauthorised access to the site, its server, or any connected system;
- probe, scan, or test the vulnerability of the site except as described under Security in our Privacy Policy, which invites good-faith reports;
- interfere with the site's operation, including by flooding the contact form or circumventing its rate limits;
- use the contact form to send advertising, solicitations, or bulk messages;
- scrape or harvest content or contact details for the purpose of building a mailing list or a competing service;
- misrepresent yourself, or submit another person's details as your own.
We may block access from any address that does any of the above, without notice.
4. Client Portal
The Client Portal at support.portnoc.net is a separate system with its own terms, reached from this site by link only. Access is granted to clients under their services agreement. You are responsible for keeping your portal credentials confidential and for activity under your account, and you must tell us promptly if you believe an account has been compromised.
5. The status page
Figures published on the system status page are historical and aggregated, published on a delay, and provided for general information only. They are not real-time telemetry, and they are not a measurement of any individual client's environment.
Nothing on that page constitutes a service level commitment or evidence of performance against one. Contractual availability figures, where they exist, are those defined in your agreement and reported through the channels it names. Clients should use the Client Portal for metrics specific to their environment.
6. Intellectual property
The content, design, layout, graphics, and code of this site are owned by PortNOC LLC or its licensors and are protected by copyright and other laws. The PortNOC name, logo, and "Always on, Always Watching" are marks of PortNOC LLC.
You may view the site and print or download extracts for your own internal reference or to evaluate our services. You may not republish, sell, or commercially exploit the content, or present it as your own, without our written permission. Third-party names and marks appearing on this site — including those of platform vendors and certification bodies — belong to their respective owners and are used only to describe the platforms we work with. Their appearance does not imply endorsement by them of PortNOC.
7. What you send us
You are responsible for the accuracy of what you submit through the contact form, and you confirm you are entitled to provide any details you include about another person or organisation.
Do not send us confidential information, credentials, or sensitive personal data through the form. A web form and the email it produces are not an appropriate channel for any of that; we will tell you a better one. Unsolicited ideas or proposals sent to us are not treated as confidential, and we cannot accept obligations of confidence over material we did not ask for.

8. Third-party links
This site links to systems we operate on other infrastructure, and may link to sites we do not control. We are not responsible for the content, availability, or practices of any external site, and a link is not an endorsement.
9. No warranty
The site is provided "as is" and "as available". While we take reasonable care to keep the information on it accurate and current, we make no representation or warranty of any kind, express or implied, that the content is complete, accurate, or up to date, or that the site will be uninterrupted, timely, or free of errors or harmful components.
To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, PortNOC LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or in connection with your use of, or inability to use, this website — whether in contract, tort (including negligence), or otherwise, and even if we have been advised of the possibility.
Our total aggregate liability arising out of your use of this website will not exceed one hundred United States dollars (US$100).
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. This clause limits liability for this website only; liability under a services agreement is governed by that agreement.
11. Governing law
These terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of laws rules. You and PortNOC submit to the exclusive jurisdiction of the state and federal courts located in Outagamie County, Wisconsin for any dispute arising out of this website.
If any provision of these terms is found unenforceable, the remaining provisions continue in full effect. Our failure to enforce a provision is not a waiver of it.
12. Changes
We may revise these terms at any time by updating this page. The date at the top shows when they were last changed, and the version in force is the one published when you use the site. Please check back from time to time.
